Terms of Service — Abaton

These terms are the agreement between you and me for the use of Abaton, an astrology affirmation app for Android.

I am Ilgar Mammadov, an individual developer based in Baku, Azerbaijan. There is no company behind the app — one person writes, builds and maintains it. You can reach me at imappdevelopment@outlook.com.

By installing or using Abaton you accept these terms. If you do not accept them, please do not use the app.

Nothing here takes away rights you have under the consumer law of your own country. Where these terms and your local consumer law disagree, your local law wins.


1. Who may use Abaton

Abaton is for people aged 18 and over. By using it you confirm you are at least 18. If you are under 18, please do not use the app.

You also need a Google account and a device running Android 8.0 (API 26) or later.


2. What Abaton is — and what it is not

Abaton computes an astrological chart from your birth details and the current positions of the planets, and selects a written affirmation to match. You can have that affirmation read aloud.

Please read this part properly.

Abaton is intended for reflection, curiosity and enjoyment. Astrology is not a science, and nothing the app produces is a prediction, a diagnosis or a recommendation.

Abaton is not medical advice, psychological or psychiatric advice, therapy, financial advice, legal advice, or a substitute for any of them. Do not use it to make decisions about your health, your money, your relationships, your safety or anything else that matters. If you are struggling with your mental health, please speak to a qualified professional or a crisis service in your country — an affirmation app is not a substitute for a person, and I would rather say that plainly than let the app imply otherwise.

The affirmations are general text. They are not written for you personally, not reviewed by a clinician, and not tailored to any circumstance you may be in.


3. No account

Abaton has no sign-up, no login and no user account. Your birth details stay on your device. See the Privacy Policy for exactly what the app does and does not collect.

Because there is no account, everything the app knows about you lives on your phone. Uninstalling the app, or using Settings → Delete all my data, removes it permanently. I cannot recover it for you afterwards, because I never had it.


4. The free version and the subscription

Part of Abaton is free. A subscription unlocks the personalised affirmation written for your own birth chart, its spoken playback, and the full set of zodiac signs on the Rise tab.

How the subscription works

Cancelling

Cancel any time in Google Play → Payments & subscriptions → Subscriptions, or through the Manage subscription link in the app's Settings.

Cancelling stops the next renewal. It does not cut off access immediately: you keep the paid features until the end of the period you have already paid for. Cancel at least 24 hours before the renewal date, as Google requires.

I cannot cancel a subscription on your behalf — only you or Google can, because Google holds the billing relationship.

Refunds

Purchases are made through Google Play, so Google's refund policy applies and Google, not I, processes refunds. Start at support.google.com/googleplay.

If Google declines and you believe you have a fair case, write to me. I will consider it and take it up with Google where I can, but I cannot issue a refund directly and I will not pretend otherwise.

If you live in the EU, UK or another place with a statutory right to withdraw from a digital purchase, that right stands. Note that where you ask for immediate access to digital content, that right may end once delivery begins — Google explains this during the purchase.

Price changes

If the subscription price changes, Google will tell you in advance and ask for your consent where the law requires it. You can always cancel rather than accept a new price.


5. What you may and may not do

You may install and use Abaton on devices you control, for your own personal, non-commercial use.

The last two matter more than they may look. The spoken audio is served from infrastructure I pay for personally, and abuse of it costs me money directly and could force me to withdraw the feature for everyone.


6. Who owns what

The app, its design, its code, the affirmation texts and the generated audio remain mine, or my licensors'. Nothing in these terms transfers ownership.

What you get is a personal, non-exclusive, non-transferable, revocable licence to use Abaton under these terms, for as long as you comply with them.

Your birth details are yours. I claim no rights over them — and, as the Privacy Policy explains, they never reach me in the first place.

Abaton uses Astronomy Engine by Don Cross, under the MIT licence, for its astronomical calculations.


7. Services I depend on

Abaton relies on Google Play for distribution and payments, on Firebase for crash reporting, analytics and app integrity, and on Google Cloud for the audio service. Your use of Google's services is governed by Google's own terms.

If one of those services fails, parts of Abaton will not work. I will fix what I can, but I do not control them.


8. Availability and changes to the app

I try to keep Abaton working and available, but I do not guarantee it will be uninterrupted or error-free. It is maintained by one person.

I may add, change or remove features. If I remove something a subscription paid for, and you are still paying for it, you may cancel and — where the law entitles you to it — seek a refund for the part you did not receive.

I may stop offering Abaton entirely. If I do, I will give reasonable notice in the app where I can, stop charging new subscription periods, and let existing paid periods run their course.


9. Disclaimers

Except for anything that cannot lawfully be excluded, Abaton is provided "as is" and "as available", without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

I do not warrant that the astrological calculations are accurate, that the affirmations are suitable for you, or that using the app will produce any particular result. Chart calculations depend entirely on the birth details you enter; if those are wrong, the output will be wrong, and the app cannot tell.


10. Limitation of liability

Nothing in these terms limits my liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Subject to that, and to the fullest extent the law allows:

This is a free-or-few-dollars app maintained by one person. The limit reflects that, and it does not displace any right your local law gives you.


11. Ending this agreement

You may end it at any time by uninstalling the app. If you have a subscription, cancel it in Google Play as well — uninstalling does not cancel a subscription, and Google will keep charging you until you do.

I may suspend or end your access if you materially breach these terms, in particular section 5. If I do that while you have paid for a period you have not used, I will not keep money for a service I have cut off, except where the breach itself caused the loss.

Sections 6, 9, 10 and 12 survive the end of this agreement.


12. Governing law and disputes

These terms are governed by the law of the Republic of Azerbaijan, and the courts of Azerbaijan have jurisdiction.

If you are a consumer resident in the EU, the UK, or another country whose law gives you the right to bring proceedings locally and to the protection of your own consumer law, that right is not taken away by this section.

Before going to court, please write to me. Most problems are a misunderstanding or a bug, and I would rather fix it than argue about it.


13. Changes to these terms

I may update these terms. If a change is material, I will update the effective date above, publish the new version at this address, and note it in the app.

Continuing to use Abaton after a change means you accept the updated terms. If you do not accept them, stop using the app and cancel any subscription.
