The short version

Freemason's Encyclopedia is a reader for a reference book published in 1929. The book is free. One optional payment adds a personal layer — a notebook, history, and export — on top of it.

Three things are worth knowing before you read the rest:

Using the app means you accept these terms. If you do not accept them, do not install or use it.


1. Who these terms are between

These terms form an agreement between you and IMdevelopment, a sole developer (Ilgar Mammadov) based in Baku, Azerbaijan ("we", "us", "the developer"). They govern your use of the Freemason's Encyclopedia Android application and everything in it ("the app").

They do not replace the terms of whoever distributed the app to you. The app is distributed through Google Play, and the Google Play Terms of Service and Google's payment terms apply to your download and to any purchase alongside these terms. Where Google's terms give you rights against Google, these terms do not take them away.

Our handling of data is described in the separate Privacy Policy, which forms part of these terms.


2. Accepting these terms

By downloading, installing or using the app, you accept these terms. If you do not accept them, uninstall the app and do not use it.

You must be old enough to hold a Google account in your country and to enter into a binding agreement. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian, who accepts these terms on your behalf. The app is a reference work for adults and is not directed at children.


3. Your device

The app requires Android 7.0 or later. Reading, browsing and searching work with no network connection. An internet connection and the Google Play Store app are required to make or restore a purchase.

We do not guarantee that the app will run on every device, on every version of Android, on modified or rooted systems, on emulators, or after a future Android release changes behaviour the app depends on. Devices vary, and some manufacturers alter Android in ways we cannot test for or anticipate.


4. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the app on devices you own or control, for your own private, non-commercial use, for as long as these terms are observed.

That is a licence to use the app. Nothing in it transfers ownership of the app, of its code, or of the compiled database of articles inside it.

This matters more than any other section, so it is set out in full.

Source. The app reproduces An Encyclopedia of Freemasonry by Albert G. Mackey, in the 1929 edition. That edition was published in 1929 and is understood by us to be in the public domain in the United States and in other jurisdictions applying comparable terms. We make no promise about its copyright status in every country in the world; if you believe material in the app infringes a right you hold, see "Copyright complaints" below.

It is a scan, and it shows. The text was produced by optical character recognition of printed pages. Despite a repair pass, it contains recognition errors, irregular spacing, dropped characters where the printed page carried Hebrew, Greek or illustrations, and some articles that end mid-sentence exactly as the scan left them.

It is not the complete book. A number of headwords printed in the 1929 edition have no article in the app, and some cross-references point at articles that are not present. We correct what we find, but we do not represent that the app contains the whole of the printed work.

The contents change between versions. Articles are corrected, added, renamed and sometimes removed as the text is revised against the printed edition. An update may therefore not contain everything an earlier version did, and an article you have read before may have changed or may no longer be present. Article counts stated anywhere in the app, in its store listing or in these terms describe the version they appear in, and are not a promise about any future version.

It is a historical text, and we do not endorse it. The book was written in and before 1929. It contains attitudes, terminology and statements about race, religion, nationality and gender that were ordinary in its time and are offensive now, and it contains claims of history, medicine, science and religion that are wrong. It is reproduced as published, because altering a historical document to suit present taste would make it useless as a record of what it is. Its contents are the author's, not ours, and their presence in the app is not our endorsement of them.

It is not advice. Nothing in the app is legal, medical, financial, religious, historical or professional advice, and it must not be relied on as a statement of current fact. Do not act on anything in the app without checking it against a current source.

No affiliation. The developer is not affiliated with, endorsed by, sponsored by or acting for any Grand Lodge, Masonic body, obedience, order or organisation. The app is an independent reader for a published book. Names of organisations appearing in the text are used as they appear in the 1929 book, in a historical work of reference, and their appearance implies no connection with, or approval by, any body bearing such a name today. The app confers no standing, membership, recognition or authority of any kind.


7. What is free, and what is paid

The encyclopedia itself is free, and will remain free in this app. All of its articles, the A–Z browse, headword search, full-text search, the links between articles, the random word and the day/night theme are available at no charge and will not be moved behind a payment in a later version of this app. Where the number of articles is stated, it describes the version stating it; the commitment is that the book is free, not that its article count is fixed.

The Full Edition is a single optional purchase that adds a personal layer around the book:

These features have never been free in any released version of the app, and nothing that was free has been made paid.

We may add, change or withdraw features in either group in a future version, except for the commitment above that the book stays free. If we ever withdraw a feature of the Full Edition entirely, we will say so in the release notes.


8. Buying the Full Edition

The seller is Google. The Full Edition is a one-time, non-consumable in-app product sold through Google Play. The transaction is between you and Google, on Google's terms, and Google handles payment, tax and invoicing. We never receive or hold your payment details.

The price is shown in the app before you commit to buy, in your own currency, including tax where Google adds it. Prices may change for future buyers; a change never affects a purchase you have already made.

It is one payment, not a subscription. Nothing recurs, nothing renews, and there is no charge after the first.

The purchase belongs to your Google account, not to your phone. Reinstalling the app, or installing it on another device signed in to the same Google account, restores it — open the menu, tap "Full Edition" and use "Restore purchase" if it does not appear immediately. It follows that we cannot restore a purchase to a different Google account, and that if you lose access to the account you bought with, the purchase is not recoverable by us. Sharing arrangements such as Google Play Family Library are Google's feature and operate on Google's terms.

The app asks Google whether you own the product, and stores that answer on the device so that it can be trusted while you are offline. If a purchase is refunded, revoked or charged back, the Full Edition features stop being available once Google reports it. Where a purchase cannot be verified because of a network, Play Store or account problem, we do not treat that as a reason to remove what you paid for.

Refunds are handled by Google under Google Play's refund policy, and that is where to start. Where the law where you live gives you a right of withdrawal or a statutory remedy for a faulty digital product, you keep it in full and may also raise it with us at the address above. Beyond that, purchases are not refundable by us, and we do not refund because a future version changes, adds or removes something, or because the article contents changed.


9. Your data, and keeping it

It is on your phone, and nowhere else. Your favourites, your reading history and the notes you write are stored in the app's private storage on your device. We do not receive them, cannot read them, and hold no copy. There is no account, no cloud storage and no synchronisation between devices.

Your notes are yours. You keep every right in what you write, and you are responsible for what you write. Because they never leave your device unless you export them, we neither review nor moderate them.

They can be lost, and we cannot get them back. Uninstalling the app, clearing its data or storage, a device reset, a lost, broken or stolen phone, a failed Android backup or restore, a storage fault or a defect in the app can all destroy them permanently. Since we hold no copy, there is no recovery from us. If your notes matter to you, export them regularly and keep the file somewhere safe. To the fullest extent the law allows, we are not liable for the loss, corruption or unavailability of data held on your device, however it is caused.

Export and import is not a backup service. Exporting writes a file to a location you choose, through Android's own file picker, and our involvement ends when the file is written. Nothing is uploaded and nothing is kept for you. Where you put the file afterwards, and who can read it, is your responsibility — the file contains your notes in plain, readable text. Importing adds the contents of a file to what is already on the device and deletes nothing, but where the same word carries a note in both, the newer of the two replaces the older, which can overwrite a note on your device. Import only files you exported yourself; we make no promise about a file produced or altered by anything else, and a file written by a newer version of the app may be refused by an older one.


10. Changes, updates and availability

We may change, update, suspend or discontinue the app or any part of it, and we may stop supporting it entirely, at any time and without notice to you individually. Updates may change how features work and may alter, add or remove article contents as described above.

The app is offered as it is at the time you install it. We do not promise that updates, corrections, new articles or support will be provided, that the app will remain available on Google Play, or that it will remain compatible with future versions of Android. We are not responsible for the acts or availability of Google Play, Google Play Billing, Firebase or any other third-party service the app depends on.

11. Our intellectual property

The app itself — its source code, design, interface, layout, icons, illustrations, the name "Freemason's Encyclopedia" as used for it, and the selection, correction, arrangement and compilation of the articles into a searchable database — belongs to the developer and is protected by copyright and other laws.

The underlying 1929 text is not claimed as ours, and nothing here asserts a new copyright in a public-domain work. What is ours is the app and the work of preparing, correcting and compiling that text into it.


12. Copyright complaints

If you hold rights in material that you believe appears in the app without permission, write to imappdevelopment@outlook.com identifying the material, the article or articles it appears in, the basis of your claim and your contact details. We will review it and, where the claim is substantiated, remove or alter the material in the next release.


13. No warranty

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranty of any kind, express or implied. In particular, and without limiting that, we do not warrant that:

Anything you do on the strength of what you read in the app, you do at your own risk.


14. Limitation of liability

To the fullest extent permitted by law:

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability the law of your country does not allow to be excluded.


15. Your rights as a consumer

If you deal with us as a consumer, you have rights under the law of the country where you live that these terms cannot take away. Nothing here affects them.

In particular, statutory rights concerning digital content that is not as described, not of satisfactory quality or not fit for purpose remain available to you in full, alongside Google Play's own refund policy, whatever any other section of these terms says.


16. Indemnity

You agree to indemnify us against any claim, loss or reasonable cost arising from your use of the app in breach of these terms or in breach of the law, or from your infringement of anyone else's rights. This does not apply to anything caused by us, and it does not apply where you are acting as a consumer and the law where you live does not permit such an indemnity.


17. Termination

Your licence ends if you stop using the app or uninstall it, and we may end it if you materially breach these terms — in particular by redistributing the app or its database, or by circumventing the purchase check.

Ending the licence does not entitle us to keep the price of a purchase where the law or Google Play's policies require it to be refunded. Uninstalling the app deletes the data held on your device, including your notes.

The sections on the book's condition, intellectual property, warranties, liability, indemnity and governing law survive the end of these terms.


18. Changes to these terms

We may revise these terms — for example when the app gains a feature, or when the law changes. The current version always sits at the address where you are reading this, with the date at the top. Where a change materially reduces your rights, we will note it in the app's release notes on Google Play. Continuing to use the app after a revision means you accept it; if you do not, stop using the app and uninstall it.

Changes are not retrospective: a purchase already made is governed by the terms in force when you made it.


19. Governing law and disputes

These terms are governed by the law of the Republic of Azerbaijan, and the courts of Azerbaijan have jurisdiction over any dispute.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your own country's courts. Before starting any dispute, please write to imappdevelopment@outlook.com — nearly everything is settled faster that way.
